Terms of Use

These Terms of Use define the procedure for using the online store, the rules for purchasing goods, and the rights and obligations of the parties.

The operator of the online store is SIA “KOMEKS”, registration No. 40103103167 (hereinafter – the Seller).

By placing an order in the online store, the Customer confirms that they have read these Terms and agree to them.

Making a purchase in the online store is considered the conclusion of a distance contract in accordance with the Consumer Rights Protection Law of the Republic of Latvia.

The Seller has the right to update these Terms at any time. Changes take effect from the moment they are published on the website.

1. User Account

In the online store, the Customer may create a user account in which it is possible to save personal information, manage delivery addresses, view order history, and track order statuses.

The Customer is responsible for the security of their access credentials and undertakes not to disclose them to third parties.

The Customer is responsible for ensuring that the information provided in the user account is up to date and accurate.

The Seller has the right to restrict or delete a user account if unauthorized, fraudulent, or security-threatening use of the system is detected.

2. Placing an Order

An order can be placed in the online store by selecting products, adding them to the shopping cart, and completing the order information.

When placing an order, the Customer must provide complete, accurate, and truthful information necessary for order processing, delivery, and communication.

After placing the order, the Customer receives an order confirmation to the provided email address.

The Seller reserves the right to contact the Customer to clarify order information or order fulfilment conditions.

If it is not possible to contact the Customer and the order cannot be fulfilled, the Seller has the right to cancel the order.

3. Prices and Product Availability

All product prices in the online store are stated in euros and include value-added tax (VAT), unless otherwise provided by applicable regulations.

Discounts or special offers may apply to certain products.

Delivery costs are calculated separately during the order checkout process.

The Seller strives to ensure up-to-date information on product availability; however, due to technical or warehouse data discrepancies, certain products may not be available.

If the ordered product is not available, the Customer is informed and the paid amount is refunded in accordance with the procedure established by applicable law.

4. Payments

Orders can be paid for using the payment methods available in the online store.

Payments are processed through payment service providers.

The online store does not store full bank card or authentication data.

Order processing may begin after confirmation of payment has been received.

Before making a payment, the Customer is responsible for checking the terms and limits of the selected payment method.

5. Order Fulfilment

Order fulfilment begins after its confirmation and, if necessary, after payment has been received.

The Seller makes every effort to ensure that the order is prepared and handed over for delivery within a reasonable time.

If circumstances arise that delay order fulfilment or delivery, the Customer will be informed as soon as possible.

The terms and conditions for the delivery and collection of goods are described in detail in the Payment and Delivery section.

6. Liability

The Seller shall not be liable for losses or delays in order fulfilment resulting from incorrectly provided information, the actions of delivery partners, technical disruptions, or other circumstances beyond the Seller’s control.

The Customer undertakes to use the online store in good faith and not to engage in any activities that may disrupt the operation, security, or availability of the website.

The Seller shall not be liable for any use of the product that is contrary to the manufacturer's instructions or the product’s intended purpose.

7. Complaints and Dispute Resolution

Complaints regarding orders, product quality, or services may be submitted electronically to komeks@komeks.lv.

The Seller shall review complaints within a reasonable period and provide a response using the contact information specified by the Customer.

If the Customer wishes to exercise the right of withdrawal and withdraw from a distance contract, the online store’s Right of Withdrawal shall apply, setting out the procedure for submitting a withdrawal notice, returning goods, and obtaining a refund.

If a dispute cannot be resolved amicably, the Customer has the right to make use of the out-of-court dispute resolution procedures provided for by applicable law.

8. Commercial Communications

The Customer may consent to receive news, special offers, and other informational content.

Commercial communications are sent only in accordance with applicable laws and regulations and with the Customer’s consent, where such consent is required.

Consent may be withdrawn at any time by using the unsubscribe option included in the received communications or by contacting the Seller.
